Multi-million-dollar financial crime occurring under the nose of circuit court judge

Dale Wilson; whose son; Adam died one year ago, on his 38th birthday, was in circuit court Wednesday challenging a suspicious Will alleged to be that of his late son. Judge Kyle Atkins dismissed Wilson’s challenge to the will while admitting he had read none of Wilson’s pleadings filed in the case.

After pointing out several problems with the suspicious Will including introduction of hand-writing Expert; Grant Sperry’s Affidavit stating the signature of the decedent on the Will is a forged signature. Wilson also pointed out, and the judge agreed, the will is not signed by any witnesses. Wilson claimed, and the judge agreed, the attestation clauses were not written upon nor attached to the Will as required by state law yet still ruled the Will valid. But not before Wilson announced to the court, “There is a multi-million-dollar financial crime happening right in front of this court and this court has done nothing to stop it.”

Under state law if a will is to be legal it must be signed by two witnesses in the presence of the will-maker or, have a signed “attestation clause” attached to the Will. Neither of these occur in the challenged Will yet the judge accepted the will as valid. There was submitted attestation clauses containing false information yet they were not attached to the Will as required by TCA 32-2-110. Still Atkins accepted them as valid and dismissed Wilson’s challenge to the patently bogus Will.

This was the second hearing in the case. The first hearing in November of 2022, ended in a dismissal of Wilson’s challenge even though the judge said, on the record, he had not seen or read any of Wilson’s pleadings and was not handed the case file until the moment he mounted the bench at the first hearing.

Wilson; representing himself, then filed; “Motion for Reconsideration Upon Familiarization With the Pleadings” This motion was granted and Wilson returned on Wednesday, March 1st with what he called “bullet-proof” citations of ruling-precedent, state statutes and Supreme Court decisions buttressing his case. All falling on deaf ears of the court.

“My main concern, Wilson said, is how can a judge rule on a million dollar case without even reading the case-file. When Wilson brought this up before the court at the second hearing Judge Kyle Atkins replied, on the record, “It’s not my job to read everything that comes in.”

“The saddest part of this Wilson said, is I filed a motion calling for the judge to become familiar with pleadings filed in the case before making a ruling yet, even on the second time around, Kyle reiterated he had not read the case file.

Wilson doesn’t believe he has not read the file. Instead he believes if he does admit he read it he is required to take certain actions such as reporting suspected Elder Abuse, financial predation and other crimes to which Wilson’s pleadings refer. Now he has plausible deniability. He can always say he never read the pleadings, if and when this scam blows up in his face.

These other “crimes” Wilson refers to surround the fact that the two co-executors of his son’s estate are the same ones who acted as executors in his mother’s estate. Wilson maintains they have bungled his mother’s estate and are now set on stealing his son’s estate.

Randi Rich; Adam’s deceased mother, was a long-time law-partner of Jack Holmes. She appointed Jack Holmes and Nancy McHaney executors of her estate. She died in 2017. Wilson says he has found where millions of dollars in investment accounts, life insurance benefits and deferred compensation; supposed to have been inherited by his son Adam, was never entered into his mother’s estate and thus was denied him for the five years he outlived his mom.

Wilson said he also found a letter to the Estate of Randi Rich, from an insurance company, dated May 20th 2021; four years after her death, asking where to send a $500,000 death benefit on the life of Randi Rich. This sum has not appeared on any tally sheet so far.

Under the terms of the bogus Will his son’s grandmother; Patsy Bulliner of Henderson, is the real person of interest yet she is unrepresented by any legal council. Wilson motioned the court early on to have a guardian provided for Mrs. Bulliner to look out for her interests but the lawyer for the executors; Chuck Exum argued there is no need for this. However, under the local rules, if a lawyer suggests a guardian in a case before the court they are provided a guardian for those at risk.

Wilson informed the court Mrs. Bulliner is non compis mentis and is incompetent to appoint executors yet the court has not investigated this and has never ruled on Wilson’s motion for a guardian for his former mother-in-law. In fact the judge has never ruled on any of Wilson’s several motions and, with the latest dismissal, looks like he never will.

Wilson said he will appeal his case’s dismissal to the state court of appeals.
