NOTICE OF SUBSTITUTE TRUSTEE’S SALE OF REAL ESTATE

WHEREAS, on February 1, 2019, DAVID BRYAN OWENS (DECEASED), by Deed of Trust of record in Trust Deed Book T2088, at Page 701, in the Register’s Office of Madison County, Tennessee, conveyed the following described property in trust to secure the payment of a Promissory Note in the original principal amount of Twenty-Seven Thousand Nine Hundred Sixty-Nine and 88/100 Dollars ($27,969.88), payable to CENTENNIAL BANK; and

WHEREAS, the undersigned was appointed Substitute Trustee by Centennial Bank the legal owner and holder of the said Note, by appointment executed on November 16, 2022, and of record in Book T2213, at Page 36, in the Register’s Office of Madison County, Tennessee; and

WHEREAS, default has been made in the payment of said indebtedness and other provisions of the Deed of Trust have been violated, and CENTENNIAL BANK, the lawful owner and holder of the indebtedness, has declared the entire amount due and payable as provided by the Deed of Trust in accordance with its terms, and instructed the undersigned to foreclose.

NOW, THEREFORE, the public is hereby notified that the undersigned Substitute Trustee will sell the hereinafter described real estate at public auction, to the highest and best bidder, for cash in hand paid, at the North door of the Courthouse at Jackson, Madison County, Tennessee, on Thursday, January 12, 2023, at 12:00 o’clock noon, said property to be sold in bar of the equity of redemption and subject to the lien of all special assessments against it. If the highest bidder cannot pay the bid within a reasonable time to be announced at the sale, the next highest bidder will be deemed the successful bidder.

Lying, and being situate in the 10 th Civil District of Madison County, Tennessee, bounded and described as follows; to-wit:

BEGINNING at a point in the east margin of the Wells and Lassiter Road at the northwest corner of a tract of land owned by Edward Lindy Collins (see Deed Book 200 at page 109 in the Register’s Office of Madison County, Tennessee) said beginning point also being the southwest corner of the 1.33 acre tract conveyed by J. W. Gilliam and wife, to Charles Rex Landers and wife, by Deed of record in Deed Book 235 at page 252 in said Register’s Office of which the tract herein described is a part; runs thence North with the east margin of said Wells and Lassiter Road a distance of 100 feet to a point; runs thence North 85 degrees 30 minutes East a distance of 300 feet to a point; runs thence South 4 degrees 30 minutes East a distance of 87 feet to a point; runs thence with the north margin of the Collins tract South 83 degrees 30 minutes West a distance of 300 feet to the point of beginning, being a lot located on the Wells and Lassiter Road, Madison County, Tennessee, and surveyed by McAlexander Engineering on September 17, 1984. It being the same property as that described in a Quitclaim Deed from Lura Mae Owens to David Bryan Owens, dated August 21, 2017, and of record in Book D741, at Page 1193, in the Register’s Office of Madison County, Tennessee. David Bryan Owens died intestate, a resident of Madison County, Tennessee, on August 16, 2022, and was survived by four (4) children; namely: Kristen McCord; Haley Owens; Kendal Owens; and David Wayne Owens, who as the sole heirs at law of David Bryan Owens, became the owners of said property under the laws of descent and distribution. See Affidavit of Heirship of David Bryan Owens of record in Book D, at Page 1818, in the Register’s Office of Madison County, Tennessee.

A 2014 SOHM 42V HS, Serial No. SA4062898ALAB is located on the above- described property and is included in this sale.

The street address of the above-described property is believed to be 338 Wells Lassiter Rd, Jackson, TN 38301, but such address is not part of the legal description of the property sold herein and in the event of any discrepancy, the legal description herein shall control.

SALE IS SUBJECT TO TENANT(S) RIGHTS IN POSSESSION, IF ANY.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. Other interested parties: None. Title to said property is believed to be good, but the undersigned will sell as Substitute Trustee only and will assign to the purchaser all covenants of warranty contained in said Deed of Trust.

The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time. Said sale may be adjourned to another time or may be postponed to another date by public announcement at the appointed time of sale without readvertisement.

This office is a debt collector. This is an attempt to collect a debt and any information obtained will be used for that purpose.
