NOTICE OF SUBSTITUTE TRUSTEE’S SALE OF REAL ESTATE
        WHEREAS, on April 21, 2005, MARK S. POWELL AND WIFE, CATHERINE C.
POWELL, by Deed of Trust of record in Book T1665, at Page 664, in the
Register’s Office of Madison County, Tennessee, conveyed the following
described property in trust to secure the payment of a Promissory Note
in the original principal amount of Eight Hundred Thousand and 00/100
($800,000.00) payable to Farm Credit Mid-America, FLCA f/k/a Farm
Credit Services of Mid-America, FLCA; and
        WHEREAS, the undersigned was appointed Substitute Trustee by
FARM CREDIT MID-AMERICA, FLCA, the legal owner and holder of the said
Note, by appointment executed on January 24, 2017, and recorded in
Book T2039, at Page 110, in the Register’s Office of Madison County,
Tennessee; and
        WHEREAS, default has been made in the payment of said
indebtedness and other provisions of the Deed of Trust have been
violated, and FARM CREDIT MID-AMERICA, FLCA, the lawful owner and
holder of the said indebtedness, has declared the entire amount due
and payable as provided by the Deed of Trust in accordance with the
terms thereof, and instructed the undersigned to foreclose; and
        NOW, THEREFORE, the public is hereby notified that the
undersigned Substitute Trustee will sell the hereinafter described
real estate at public auction, to the highest and best bidder, for
cash in hand paid, at the north door of the Courthouse at Jackson,
Madison County, Tennessee, on Thursday, March 16, 2017, at 12:00
o’clock noon, said property to be sold in bar of the equity of
redemption and subject to the lien of all special assessments against
it.  If the highest bidder cannot pay the bid within twenty-four (24)
hours of the sale, the next highest bidder will be deemed the
successful bidder.
Lying, and being situate in the 3rd Civil District of Madison County,
Tennessee, bounded and described as follows; to-wit:
LOT 12, The Estates at Oakhaven Subdivision, a plat of which is
recorded in Plat Book 10, Page 161, Register’s Office, Madison County,
Tennessee.
Subject to Covenants, conditions, restrictive easements and set back
line as shown on above referenced Plat and Easements contained in Deed
Book 660, Page 500 and Deed Book 658, page 654, Register’s Office,
Madison County, Tennessee.

BEING the same property conveyed to Mark S. Powell by deed of R. Joel
McAlexander and Shane McAlexander, dated February 25, 2005, and
recorded in Book D663, Pages 758-759, Register’s Office, Madison
County, Tennessee.  Mark S. Powell conveyed an interest to his wife,
Catherine C. Powell to create an estate by the entirety, by deed
recorded in Deed Book D666, Page 202, said Register’s Office.
Map 032, Parcel 003.46
The street address of the above described property is believed to be
29 Bentbrook Cove, Jackson, Tennessee 38012, but such address is not
part of the legal description of the property sold herein and in the
event of any discrepancy, the legal description herein shall control.
SALE IS SUBJECT TO TENANT(S) RIGHTS IN POSSESSION
Title to said property is believed to be good, but the undersigned
will sell as Substitute Trustee only and will assign to the purchaser
all covenants of warranty contained in said Deed of Trust. Other
interested parties:  Sun Trust Bank and Community Bank.
This property is subject to covenants, conditions, restrictive
easements and set back line as shown in Plat Book 10, Page 161, in the
Register’s Office of Madison County, Tennessee.
This property is subject to Plat and Easements contained in Deed Book
660, Page 500 and Deed Book 658, page 654, in the Register’s Office of
Madison County, Tennessee, and other easements, rights-of-way,
covenants, and conditions of record in the public records of Madison
County, Tennessee.
        Said sale may be adjourned to another time or may be postponed
to another date by public announcement at the appointed time of sale
without readvertisement.
