NOTICE OF FORECLOSURE SALE
(61 Charjean Drive)
        WHEREAS, on March 14, 2008, Bennie H. Weaver and Terrie H. Weaver
executed a Real Estate Deed of Trust (ATrust Deed@) in favor of Jerry
P. Spore, Trustee, to secure an indebtedness described therein (the
“Note”), the same being payable to BancorpSouth Bank said Trust Deed
being of record in the Register=s Office of Madison County, Tennessee,
in Trust Deed Book 1829, Page 91, to which reference is hereby made;
and
        WHEREAS, default has been made in the payment of the Note; and
        WHEREAS, the owner and holder of the Note has demanded that the
hereinafter described real property be advertised and sold in
satisfaction of indebtedness and costs of foreclosure in accordance
with the terms and provisions of the Note and Deed of Trust.
        NOW THEREFORE, notice is hereby given that I, Jerry P. Spore,
Trustee, pursuant to the power, duty and authority vested in and
conferred upon me, by the Deed of Trust, will on Friday, March 24,
2017, at 11:00 a.m., at the front door of the Madison County
Courthouse in Jackson, Tennessee, offer for sale to the highest bidder
for cash, and free from all legal, equitable and statutory rights of
redemption, exemptions of homestead, rights by virtue of marriage, and
all other exemptions of every kind, all of which have been waived in
the Deed of Trust, certain real property located in Madison County,
Tennessee, described as follows:
Tax Map:  43P    Group: A  Parcel:   15.00
BEGINNING at an iron pin in the north margin of Charjean Drive, said
pin being located 25 feet from the centerline of said Drive at the
back side of a concrete sidewalk, said point being the southeast
corner of Lot No. Eleven (11) of the Charles Little Subdivision, a
plat of which appears of record in Plat Book 1, Page 268, in the
Register’s Office of Madison County, Tennessee; runs thence North with
the east margin of Lot No. Eleven (11) a distance of 159.1 feet to an
iron pin at the northeast corner of said Lot No. Eleven (11); runs
thence East a distance of 70 feet to an iron pin at the northwest
corner of Lot No. Fifteen (15) in said Subdivision; runs thence South
with the west margin of Lot No. Fifteen (15) a distance of 159.1 feet
to an iron pin in the north margin of Charjean Drive, said pin being
located at the back side of a 4 foot concrete sidewalk; runs thence
West with the north margin of Charjean Drive and the back side of said
sidewalk a distance of 70 feet to the point of beginning. Being Lot
No. Thirteen (13) of the Charles Little Subdivision, platted as
aforesaid and as surveyed by Thomas L. Dean Associated on September 8,
1988.
Being the same real estate conveyed to Bennie H. Weaver in Deed Book
482, Page 553, and being the same property conveyed to Terrie Lynn
Weaver to create Tenancy by the Entirety with Bennie H. Weaver in Deed
Book 484, Page 626, in the Register’s Office of Madison County,
Tennessee. Terrie Weaver died May 14, 2015 leaving Bennie H. Weaver as
surviving tenant by the entirety. Bennie H. Weaver conveyed his
interest in the property to Katrina Lynn Pope and husband, Christopher
Noel Pope by Quitclaim Deed dated June 3, 2016 recorded in Deed Book
734, Page 1505, in the Register’s Office.
The street address of the above property is 61 Charjean Drive,
Jackson, Tennessee.
All right and equity of redemption, statutory and otherwise, homestead
and dower, are expressly waived in the said Deed of Trust.  Title is
believed to be good, but the Trustee will make no covenant of seisin,
marketability of title or warranty of title express or implied and
sell and convey only as Trustee.
The property shall be sold AS IS, WHERE IS AND WITH ALL FAULTS and
without any representations or warranties of any kind whatsoever,
whether express or implied
        The sale of the property shall be made subject to any and all prior
liens, encumbrances, deeds of trust, easements, restrictions, building
lines, unpaid taxes and assessments (plus penalty and interest, if
any) and matters of record, plus any and all other matters and
encumbrances superior in right to the lien of the Deed of Trust.
Further, such sale is also subject to any matter that on site
inspection or accurate survey of the property might disclose.
        The right is reserved to adjourn the day of sale to another day
certain without further publication, upon announcement at the time set
forth above.
